1. Acceptance of Terms

Welcome to FitAI Coach. By accessing or using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and FitAI Coach ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Service Description

FitAI Coach provides AI-powered personalized fitness coaching, including but not limited to:

• Customized workout plans based on your fitness level and goals
• Nutrition guidance and meal planning with Malaysian cuisine options
• 24/7 AI chatbot support for fitness-related questions
• Progress tracking and analytics
• Exercise demonstrations and instructions

3. User Accounts

3.1 Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 13 years old to use FitAI Coach. Users under 18 must have parental or guardian consent. By using the Service, you represent that you meet these age requirements.

4. Subscription and Payment

4.1 Free and Premium Plans

FitAI Coach offers both free and premium subscription plans. Premium features include unlimited workout plans, personalized meal planning, advanced progress tracking, and priority support.

4.2 Payment Terms

• Premium subscriptions are billed monthly at RM29/month
• Payment is processed through secure third-party payment processors
• Subscriptions automatically renew unless cancelled before the renewal date
• All fees are non-refundable except as required by law
• We reserve the right to change subscription prices with 30 days' notice

4.3 Cancellation

You may cancel your premium subscription at any time through your account settings. Cancellation will be effective at the end of the current billing period. You will retain access to premium features until the end of the paid period.

5. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Transmit any harmful code, viruses, or malicious software
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Impersonate any person or entity
• Collect or store personal data about other users

6. Health and Safety Disclaimer

By using FitAI Coach, you acknowledge that you are participating in physical activities at your own risk and that you have consulted with a healthcare professional if you have any medical concerns.

7. Intellectual Property Rights

7.1 Our Content

All content on FitAI Coach, including text, graphics, logos, images, videos, software, and AI-generated workout plans, is owned by or licensed to FitAI Coach and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute our content without permission
• Reverse engineer or decompile any part of the Service
• Remove any copyright or proprietary notices
• Use our content for commercial purposes

7.3 User Content

You retain ownership of any content you submit to the Service (photos, progress data, etc.). By submitting content, you grant us a worldwide, royalty-free license to use, store, and display your content solely for providing and improving the Service.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy.

We collect and process:

• Account information (name, email, password)
• Fitness data (height, weight, age, fitness goals)
• Progress data (workout completion, measurements)
• Usage data (app interactions, feature usage)

We use Firebase services for authentication and data storage, which comply with international data protection standards.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FitAI Coach is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not guarantee that the Service will be uninterrupted, secure, or error-free
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for injuries, health issues, or damages resulting from your use of the Service

10. Indemnification

You agree to indemnify, defend, and hold harmless FitAI Coach, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any injuries or health issues resulting from your use of our workout plans

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Any other reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

1. Good faith negotiations between the parties
2. Mediation, if negotiations fail
3. Arbitration in Kuala Lumpur, Malaysia, if mediation fails

13. Third-Party Services

FitAI Coach may integrate with or link to third-party services, including:

• Firebase (Google) for authentication and data storage
• Payment processors for subscription billing
• Analytics services for app improvement

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is subject to their respective terms and conditions.

14. Changes to the Service

We reserve the right to:

• Modify or discontinue any part of the Service at any time
• Change features, functionality, or content
• Update pricing for premium subscriptions with notice
• Impose limits on certain features or restrict access

We will make reasonable efforts to notify you of significant changes, but we are not obligated to do so.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitAI Coach regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
